Ca DAILY WORLD TUESDAY, JUNE 15, 1999 3 STATE Joseph Marcello dies NEW ORLEANS Joseph Marcello a retired restaurateur and the brother of the late reputed Orleans mob boss Carlos Marcello, died Saturday of congestive heart failure Memorial Medical Center. at. was 75. Joseph Marcello at one time owned Elmwood Plantation, La Louisiane, Lenfant's and Broussard's restaurants. In 1978, a fire destroyed Elmwood Plantation, a celebrated restaurant in an 18th century French Colonial plantation home on River Road in Jefferson Parish.

During the 1980s, Marcello talked of restoring it but, in 1988, he filed federal bankruptcy proceedings to protect himself from more than $2.1 million in debts. In the mid-1990s, Joseph Marcello was the object of federal and state prosecutions. He was charged with racketeering after a federal investigation of Worldwide Gaming, Bally Gaming's exclusive distributor of video poker machines. Marcello and eight other defendants pleaded guilty to racketeering in September 1995, and he was sentenced to 33 months in prison. Trial on gill net ban I challenged 'NEW ORLEANS Attorneys for the state and a sport fishing group have asked a federal judge to deny commercial fishermen a trial of their federal court lawsuit against Louisiana's gill net ban.

Lawyers for the commercial fishermen asked last month for the trial, arguing in court documents that U.S. District Judge G. Thomas Porteous Jr. clearly erred when he threw out their suit in April without going through the formalities of a trial. "In documents filed earlier this month, attorneys for the state Department of Wildlife and Fisheries, the Wildlife and Fisheries Commission and the Coastal Conservation Association of Louisiana countered that Porteous' order was "correct" and contained "no manifest legal error." Former sheriff pleads guilty to theft NATCHITOCHES- Instead of standing trial Monday, former Natchitoches Parish Sheriff Norm Fletcher pleaded guilty to the felony theft of railroad crossties in 1998 and was sentenced to two years of probation.

The sentence also included a $598 fine and a two-year prison term, which was suspended by state District Judge Monty Doggett as part of a plea agreement between Fletcher, who represented himself in court, and parish prosecutors. "I didn't want to battle something that it's best not to gamble with. I'm considering what I ended up getting," said Fletcher. Fletcher, 67, was arrested in March 1998 when investigators found 20 Kansas City Southern railroad crossties valued at about $700 on property he owned in the nearby town of Campti. AOL Chairman Steve Case wondered whether Microsoft might not retaliate "given current antitrust attention" if AOL switched its nearly 17 million subscribers to Netscape's browser, suggesting that the software giant might be intimidated into inaction by the government's legal case. But AOL's president and chief operating officer, Robert Pittman, argued to Case that Microsoft was "too strong to throw them out of the tent." Days later in another e-mail, Case asked for an analysis of the deal's implications, ing an analysis of what would happen if we got really aggressive and swapped out" Microsoft's browser for Netscape's.

Other documents, disclosed Monday at Microsoft's antitrust trial, confirmed that Netscape currently is working to create for AOL subscribers a version of its browser software under the project name "Raptor." Medical helicopter crashes killing 4 JACKSON, Ky. -A University of Kentucky medical helicopter crashed shortly after takeoff in eastern Kentucky, killing all four people aboard. The victims in Monday night's crash were two pilots, a flight nurse and a paramedic, said Mary Margaret Colliver, a spokeswoman for the UK Hospital in Lexington. Their names were not immediately released. No patients were aboard, she said.

The Sikorsky S-76 helicopter had lifted off from the Jackson airport shortly after 10 p.m. on its way to Lexington, Colliver said. Airport officials later lost contact with the aircraft, she said. 1M Greenspan hints 1 at interest hike WASHINGTON The United States cannot rely on rising productivity to keep inflation under control forever, Federal Reserve Chairman Alan Greenspan said Monday a sign to some analysts that the Fed may raise interest rates to slow the red-hot economy and keep inflation at bay. Greenspan, opening a threeday congressional summit on high technology, credited American investment in productivity-enhancing equipment, such as microprocessors, satellites and high-speed communications lines, for the nation's productivity boom.

Those productivity gains have fueled America's remarkable economic growth and helped keep inflation low, he said. Productivity the amount of output per hour of work has been growing at an annual rate of around 2 percent since 1995, double the annual gains of the previous two decades, Greenspan told the congressional Joint Economic Committee. "The growth of productivity cannot increase indefinitely," he said. "While there appears to be considerable expectation in the business community, and possibly Wall Street, that the productivity acceleration has not yet peaked, experience does advise caution." Ethnic Albanian rebels moved in as well, taking positions vacated by departing Serbs.

Russia, meanwhile, sent an 11- vehicle convoy from Bosnia to resupply its troops at the airport in Pristina, the capital of Kosovo. Russian control of the airport has caused an embarrassing diplomatic standoff as Western nations struggle to reach an agreement with Russia over its role in the massive peacekeeping mission. Yugoslav police are expected to pull out most of their forces from the Pristina area today under terms of the peace agreement that calls for all police, paramilitaries and soldiers to be out of Kosovo by Sunday night. NATO officials said about 15,000 allied troops known under the operation name KFOR had entered Kosovo by Monday, U.S. Marines.

"The deployment of KFOR is on schedule," said NATO Secretary General Javier Solana. "The withdrawal of the Serbian forces is also on The Russian convoy included paratroopers and supplies for the 200-300 Russian troops at the airport, the Russian Defense Ministry said. Maj. David Scanlon, a NATO spokesman, said the convoy had 29 people. The surprise arrival of the Russian troops ahead of NATO has given Moscow greater leverage in negotiations over its place in the peacekeeping force.

So far, they have refused to let British troops enter the airport. NATO troops continued to take up new positions, today as Serbs retreated. troops moved out from Pristina to the town of Podujevo, 20 miles north. NATO troops also took over part of the Serb police headquarters in Pristina after Serb authorities pulled out from three of the complex's four buildings. They are scheduled to withdraw completely by midnight.

A smell of smoke hung over a small foyer. Soldiers put up a big NATO sign on the building and hung out a blue NATO flag. Several key Serb positions have been taken over by the Kosovo Liberation Army, which is supposed to be "demilitarized" under the U.N. Security Councilapproved plan. About 60 KLA guerrillas were manning the Morini crossing point on the Albanian-Yugoslav border used by hundreds of thousands of Kosovo Albanian refugees during the height of the Serb crackdown after Belgrade's troops abandoned the position Sunday.

German soldiers disarmed several KLA members as they tried to seize wounded Serb soldiers at the main Prizren hospital. Many Serb civilians up to 30,000 have been fleeing the province along with the Yugoslav troops.

They fear NATO peacekeepers will be unwilling or unable to protect them from reprisals by returning ethnic Albanians. Ethnic Albanian refugees more than 850,000 in all began streaming out of Kosovo after the NATO bombing campaign began March 24, telling of massacres and forced expulsions by Serb forces. The accounts could not be independently confirmed at the time, so the grisly task of investigating what happened now falls to the peacekeepers. On Monday, British troops gingerly probed the town cemetery in Kacanik, where the stench of decayed flesh hung heavy over 81 graves said to hold the remains of ethnic Albanians executed by Serbs. Meanwhile, a senior KLA figure, Hashim Thaci, insisted that the rebel group was not required to disarm under the peace accord. Thaci, quoted by the guerrillas' Kosova Press, also said the KLA was opposed to the presence of Russian peacekeeping troops seen as supporters of the Serbs calling their surprise move into Pristina's airport "a provocation."
